These Terms of Service (“Terms”) govern your access to and use of the website and services provided by El Paso Paint Parties (“El Paso Paint Parties,” “we,” “us,” or “our”). By visiting our site, submitting a form, booking an event, purchasing paint kits, or commenting on our blog, you agree to these Terms. If you do not agree, please do not use our site or services.

WHO WE ARE AND OUR SERVICES

El Paso Paint Parties organizes paint party events and related services in El Paso, Texas, including public events, private and in-home events, kids’ parties, corporate experiences, fundraising events, and the sale or provision of paint kits. Additional links on our site may lead to third-party offerings such as donation pages or online shops.

BOOKING POLICY

A non-refundable deposit of $50 is required at the time of booking to secure your event date. Bookings are confirmed only after we receive the deposit. Dates are reserved on a first-come, first-served basis; we recommend booking early to guarantee availability.

PAYMENT TERMS

To finalize your booking, the following payments apply: the deposit is due at booking; a first payment equal to fifty percent (50%) of the event cost is due fourteen (14) days before the event to allow us to prepare materials and logistics; the remaining balance is due seven (7) days before the event. We accept credit/debit cards, PayPal, and other secure payment options made available by our payment processors. Payments are processed by third-party providers; we do not store full payment card details. Failure to make payments when due may result in cancellation of the booking and forfeiture of the deposit.

CANCELLATION POLICY

For custom events and in-home parties, cancellations made seven (7) or more days before the event receive either credit to reschedule or a refund in the form of paint kits. Cancellations made fewer than seven (7) days before the event receive paint kits as compensation. For corporate, public, and fundraising events, if the customer cancels, they will receive credit to reschedule or a refund in the form of paint kits; a full refund will only be issued if the host cancels the event. Please contact us as soon as possible if you need to cancel or reschedule so we can review your options.

RESCHEDULING, NO-SHOW, MATERIALS PREPARATION

We will work with you to find a new date when possible; contact us promptly to discuss rescheduling. If no one attends the event or cancellation occurs on the day of the event, no refunds or credits will be issued; paint kits may still be provided on request. Once materials are prepared for your event—typically within seven (7) days of the event—refunds are no longer available; only credit or paint kits will be offered.

PAINT KITS

Paint kit purchases are non-refundable. If an item is missing, incorrect, or defective, contact us and we will exchange or replace the item.

PARTICIPATION GUIDELINES

Attendees should arrive on time; late arrivals may miss important instructions, and individual catch-up guidance cannot be guaranteed. Unless otherwise specified, all ages are welcome; for family-friendly events, a parent or guardian must supervise children. Participants agree to follow instructor guidance to ensure a smooth and enjoyable experience for everyone.

EVENT POLICIES

We provide all necessary art supplies for the event, including canvases, paint, brushes, and aprons. Setup and cleanup are included. If additional tables and chairs are needed, they can be provided for an extra fee by arrangement. Guests may bring beverages and snacks, subject to venue rules and applicable laws. You are responsible for complying with venue policies and for any damage you or your guests cause to the venue.

LIABILITY WAIVER

Participation in paint parties involves the use of art materials and attendance at venues not controlled by us. You and your guests participate at your own risk. El Paso Paint Parties is not responsible for injuries, damages, lost or stolen property, or accidents that occur during events. We recommend wearing appropriate clothing and taking reasonable precautions. To the extent permitted by law, our liability for any claims arising from the services is limited to the amount you paid for the affected event.

WEBSITE USE, ACCOUNTS, AND CONTENT

Your use of our website must be lawful and respectful. If our site allows user accounts or comments, you are responsible for maintaining the confidentiality of your login and for all activities that occur under your account. Site content, including text, images, logos, and designs, is owned by us or our licensors and may be used only for personal, non-commercial purposes unless we provide written permission.

BLOG COMMENTING POLICY

We encourage community conversation and reserve the right to moderate comments to maintain a positive and respectful environment. You must create an account and be logged in to comment. Comments must be respectful and relevant to the discussion; offensive, hateful, harassing, or discriminatory language is not permitted. Do not post content, images, or links that infringe copyrights or other intellectual property rights. Comments intended for self-promotion, advertising, or spam will be removed. We may remove or decline to publish any comment at our discretion, and our moderation decisions are final.
